Acceptance of Terms

By accessing or using the Mise Health application ('the App'), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the App.

These Terms constitute a legally binding agreement between you and INNOVATIVE CODE CRAFTERS SL, a company registered in Spain with NIF B26911891.

The Mise Health beta is provided by INNOVATIVE CODE CRAFTERS SL. A future Irish company may later assume operation of the service, but no such entity is currently the contracting party unless these Terms are updated and notice is provided where required.

Service Description

Mise is a personal health data management platform that allows you to:

Store and organize medical records, prescriptions, and health documents.

Manage health information for yourself and family members.

Track appointments and set health-related reminders.

Share selected health records with healthcare providers or family members.

Export your health data in various formats.

Eligibility

The App is intended for users who are at least 16 years old as a product eligibility rule.

Parents or legal guardians may create and manage accounts for minors under 16 with appropriate consent.

By using the App, you represent that you meet these eligibility requirements.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials.

You must provide accurate and complete information when registering and keep your information up to date.

You must notify us immediately if you suspect unauthorized access to your account.

You are responsible for all activities that occur under your account.

Health Disclaimer - Important Notice

MISE IS A HEALTH DATA MANAGEMENT TOOL, NOT A MEDICAL DEVICE OR HEALTHCARE PROVIDER.

Mise does not provide medical advice, diagnoses, or treatment recommendations.

The information stored in the App should not replace professional medical advice.

Always consult qualified healthcare professionals for medical decisions.

In case of a medical emergency, contact emergency services immediately.

We do not verify the accuracy of health information you upload - you are responsible for ensuring your records are accurate.

Permitted Use

You may use the App only for lawful purposes, including:

Managing your own personal health records.

Managing health records for family members with appropriate consent.

Sharing health information with healthcare providers you authorize.

You must NOT use the App to:

Upload false, misleading, or unauthorized information.

Attempt to gain unauthorized access to our systems.

Reverse-engineer, decompile, or tamper with the App.

Use the App for any illegal purpose.

Share your account credentials with others.

Data Ownership

You retain full ownership of all personal data and health records you upload to the App.

By using the App, you grant INNOVATIVE CODE CRAFTERS SL a limited, non-exclusive license to process your data solely for the purpose of providing our services.

This license ends when you delete your account or request data deletion, subject to legal retention obligations.

You can export your data at any time through the App's data export feature.

Intellectual Property

The App, including its design, code, graphics, logos, and content (excluding your personal data), is owned by INNOVATIVE CODE CRAFTERS SL or its licensors.

You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written permission.

The Mise Health name, logo, and brand assets are trademarks of INNOVATIVE CODE CRAFTERS SL and are protected by applicable trademark and intellectual property laws.

Subscriptions and Payments

Certain features of the App require a paid subscription.

Subscription fees are billed in advance on a recurring basis (monthly or annually).

You can cancel your subscription at any time through the App or by contacting support.

Refunds are provided in accordance with applicable consumer protection laws.

We reserve the right to change subscription fees with reasonable notice.

Termination

You may delete your account at any time through the App settings.

We may suspend or terminate your access if you breach these Terms of Use.

Upon termination, your right to use the App ceases immediately.

We will retain your data as required by applicable laws before permanent deletion.

Limitation of Liability

To the maximum extent permitted by Spanish and EU law:

The App is provided 'as is' without warranties of any kind.

We do not guarantee that the App will be error-free or uninterrupted.

We are not liable for any indirect, incidental, or consequential damages.

We are not liable for any health outcomes or medical decisions made based on information in the App.

Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

Nothing in these terms excludes liability that cannot be excluded under Spanish or EU law, including liability for fraud or death/injury caused by negligence.

Third-Party Websites and Services

The App may contain links to third-party websites or services for informational purposes.

We do not control these third-party services and are not responsible for their content, privacy practices, or availability.

Your use of third-party services is at your own risk and subject to their terms and policies.

Governing Law and Jurisdiction

These Terms are governed by the laws of Spain.

Any disputes will be subject to the courts of Spain, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence.

If you are an EU consumer, you may also bring proceedings in the courts of your country of residence where required by applicable law.

Nothing in these terms affects your statutory consumer rights under Spanish or EU law.
